5. Compliance with Applicable Law

- Washington real estate licensing requirements (RCW 18.85 and RCW 18.86)

- The Fair Credit Reporting Act (FCRA), as applicable to tenant screening
- Applicable local ordinances in the jurisdictions where We operate, including but not limited to those governing rental registration, inspections, tenant screening, rent increases, and eviction procedures
Nothing on this Website is intended to replace, modify, limit, or supersede any rights, obligations, disclosures, or protections required under applicable law. In the event of any conflict between the content of this Website and applicable law, applicable law shall control in all cases.
Tenants and property owners should refer to their executed lease agreements, property management agreements, and applicable statutes for the specific terms governing their legal relationships. 6. No Contractual Relationship From Website Use
Use of this Website does not create a landlord-tenant relationship, property management agreement, agency relationship, or any other contractual obligation between You and the Company. No such relationship exists unless and until a formal written agreement is executed by the relevant parties.
No communication through this Website, including any inquiry, contact form submission, or email exchange, shall be construed as creating a binding agreement or obligation of any kind on the part of the Company.

Property Listings displayed on the Website may include information provided by property owners, third-party data sources, or public records. The Company does not independently verify all information contained in Property Listings and makes no warranty or guarantee regarding:

- The current availability of any listed property

- The condition, habitability, or legal compliance status of any listed property
Property Listings do not constitute an offer to lease or rent any property. The Company reserves the right to remove, modify, or update any Property Listing at any time without notice.

This limitation of liability applies solely to Your use of the Website and the information contained therein. It does not limit or modify any rights or remedies that may be available to tenants, property owners, or other parties under applicable law, including without limitation the Washington Residential Landlord-Tenant Act (RCW 59.18), any executed property management agreement, or any other applicable statute, regulation, or ordinance.
If, notwithstanding the foregoing, the Company is found liable for any claim, the Company’s total aggregate liability shall not exceed the greater of the amount actually paid by You to the Company through the Service or one hundred U.S. dollars ($100.00).
Some jurisdictions do not allow the exclusion or limitation of certain damages. In such jurisdictions, the Company’s liability shall be limited to the greatest extent permitted by applicable law.

13. Links to Other Websites
Our Service may contain links to third-party websites or services that are not owned or controlled by the Company. The Company has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third-party websites or services.
You acknowledge and agree that the Company shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with the use of or reliance on any content, goods, or services available on or through any such third-party websites or services.

Upon termination, Your right to use the Service will cease immediately. Termination of Website access does not affect any rights or obligations arising under any separately executed written agreement, including but not limited to any lease agreement or property management agreement.
15. Governing Law and Jurisdiction
These Terms and Your use of the Service shall be governed by and construed in accordance with the laws of the State of Washington, without regard to its conflict of law principles. Any legal action or proceeding arising under or relating to these Terms shall be brought exclusively in the state or federal courts located in King County, Washington, and You consent to the personal jurisdiction of such courts.
16. Dispute Resolution
If You have any concern or dispute regarding the Service or these Terms, You agree to first attempt to resolve the dispute informally by contacting the Company at hello@nextbrick.co. The parties agree to attempt good-faith informal resolution before pursuing any formal legal action.
17. Severability and Waiver
17.1 Severability
If any provision of these Terms is held to be unenforceable or invalid by a court of competent jurisdiction, such provision will be modified to the minimum extent necessary to make it enforceable, and the remaining provisions will continue in full force and effect.
7.2 Waiver
The failure of the Company to exercise or enforce any right or provision of these Terms shall not constitute a waiver of such right or provision. No waiver of any breach shall constitute a waiver of any subsequent breach.
18. Entire Agreement
These Terms of Use, together with the Privacy Policy, constitute the entire agreement between You and the Company regarding Your use of the Website. These Terms do not govern, and are separate and apart from, any property management agreement, lease agreement, or other written contract that You may execute with the Company. In the event of a conflict between these Terms and any such separately executed agreement, the terms of the separately executed agreement shall control with respect to the subject matter thereof.
19. Changes to These Terms of Use
We reserve the right, at Our sole discretion, to modify or replace these Terms at any time. If a revision is material, We will make reasonable efforts to provide notice prior to any new terms taking effect. What constitutes a material change will be determined at Our sole discretion.
By continuing to access or use Our Service after revisions become effective, You agree to be bound by the revised Terms. If You do not agree to the new Terms, in whole or in part, please stop using the Website and the Service.
